Complainant: Mr S.K Taneja resident of Kirti Nagar, New Delhi.

1. I purchased a Hitachi Washing machine (80F/HJ3C1) from CROMA, Rohini store on 10th August 2008 at 8:00 PM vide Invoice No 151-26581 to be delivered on 11 August 2008.

2. The Washing machine was delivered on the promised date, and unpacked by the delivery agents. And they left by taking my signature.

3. An engineer visited me on 12th August 2008 morning. And at the beginning of the demonstration, I questioned the engineer about some strange design on the left bottom side of the machine, who replied that it wasn’t a design but a big dent.

4. I asked the engineer that the Hitachi company should replace the Washing Machine, as it seems to be defective. As even the packing material was damaged at the very same place, which proves the damage was done to the said machine, while it was in packed condition.

5. The Engineer advised me to contact the dealer but even after trying to contact the show room several times between 12:30 PM till 4 PM on 12th August 2008, no proper response was received, while engineer also kept waiting till 3 PM. I was told every time over the telephone by the CROMA receptionist, that seniors are busy in some meeting and they would call back. But no call/response was received back.

6. That all goes to show neglecting attitude of the company towards its customers, harassment of a senior citizen and malafide intention to keep things under cover, as no doubt the machine was already damaged at the Show Room before delivery.

7. As a result I had to serve a legal notice upon the CROMA store & HITACHI company, asking them to pay back up the purchase amount of Rs 23,500 (Twenty Three Thousand Five Hundred only) within a period of 7 days from the date of receipt of notice.

8. The HITACH company responded positively, but CROMA store still tried to avoid the complaint but returning Legal Notice on baseless ground that notice was directed to a Manager and we don’t have a Manager. It was really funny !

9. HITACHI company agreed to replace the Washing Machine but was not satisfied with the replaced machine, so finally I got the refund of money. Thanks to www.LegalSolutions.in !!!
