Consumer Complaints for the month of May 2009

Subject: Mobile Service

I subscribed to Reliance Mobile in 2003 March. Due to errors in their billing system they sent me SMS asking me to pay exorbitant amounts. I did  not pay. They disconnected me for 4-5 months, but continued to encash the post-dated checks that I had given. After repeated letters they re-established the connection, but did not give any consideration the charges levied during the period. I went to consumer court. Due to delay in the court, the case came up now. Now they are saying that there was no diconnection at all. I asked them to produce the Call details. They said that they keep it only for One year. So, how do I prove the disconnection ? The only notice given was the SMS. The court, when I presented this as evidence, had commented that I may have to prove that it was sent by them because the SMS had no originating (“from”) number!!!  So how do I prove the disconnection? Isn’t they who have to prove that there was no disconnection. Please advise urgently since case nearing completion.

Dear Mr Mittal,
 
I would like to bring to you note the irregularities , cheating  and the harssement i was subjected . There is actually no customer grievance redressal forum as boasted by your mobile company.
 
 Here is the brief of my complaint.
 
I being a NRI travelled last week to India and bought a new AIRTEL prepaid connection from shop “Saraswati Statitioners shop” , Shrestha Vihar , Delhi -110092. My connection # is 96500***** . I completed the form and provided Election card as proof of my residence verification.
 
My connection was activated on 15/5/2009 the date i purchased my connection. I got two calls for verification from your office on 16/5 & 17/5/2009 and they were both attended by me. The verification details were provided to
them over phone. I got my prepaid connection recharged by INR 1000/- coupons the day i purchased my connection.
 
On 18/5 my connections was deactivated without any valid reason. i tried the consumer grievances numbers as below and here are there responses:  18/5 called up 121/9810198101. call attended by Shika Sharma floor supervisor.. No help at all they were not able to tell me the reason for deactivation.
 
19/5 escalated to NODAL Officer , 9818334865, call attended by Priyanka…again not much help however she was able to tell me the reason “Denied Connection” and asked me to escalte to next level which i did..
 
19/5 escalated to Appeallate Authority,

9958444865, Aarti. This position is of no use as she has no authority to get my connection re-activated and she kept telling me sorry you have to buy another connection and my unused balance of over INR 800/- cannot be refunded as forfeited.
 
I challenge you and your company to prove that the Election ID proof submitted by me was incorrect and the verification calls response failed. There is something grossly wrong with your field operation team & consumer
grievance redressal cell as this is only a mockery…i want the person who conducted the verification check be put to task and investigated and also ensure that my connection get reactivated asap.
 
Though i have travelled back to Dubai…My contact # is 97150-45****** in  Dubai.
 
In case if i do not get response from you in next 48 hours i will be forced to escalate this complaint to Consumer Forum and Ministry of Communication.

I have problem with Sony Ericsson service team in Bangalore regarding my warranty claim of mobile phone.

I had produced the warranty certificate which I got along with my mobile phone. But they are insisting on invoice.  Please let me know if this is as per Indian Consumer Law?

I use a airtel prepaid mobile 9860629830. I had on 4 May activated the unlimited Internet service @ RS 25/day and after receiveing the confirmation sms of the service activation, I used my mobile internet to surf the net and
within 10-15 minutes, my balance depleted to Re 0.23. I have been making complaints with 121 from 5 May and I was informed that there would a refund of Rs 131, but till now I have not received a refund. The only refund done
was Rs 8. Please can you help me and suggest how should I go with this. Even after 15 days of complaints I have not been helped from 121. Few Airtel complaint numbers provided are 0518356053, 0508174067 and there are a few more which I dont have it right now.

I’m here to share with you a incident which happened on May 20 2009 while I was trying to book a ticket for my journey from Banglore to Delhi I tried doing it with a website YATRA.COM but some how the transaction failed i had
 no ticket but the money was debited from my account:1399336 of ABN AMRO BANK in Noida,since then i called YATRA my bank and mailed them also but none is giving a satisfactory help or giving status of the money lost in
transaction. I need some help in this matter from you.

Subject: Banking, Cyber Crime

My credit card (from a major private bank) was misused to book air tickets  amounting to Rs. 50,000/- from one of the travel sites online. I filed a dispute with the bank and notified them about the transaction being done without my APPROVAL / AUTHORIZATION. The bank has been stalling to divulge  the entire information about the transactions for almost two months citing reasons of some ongoing investigation (of which no details have been provided either) for the delay in information / reversal of the transactions.
 
Can I file Deficiency of services against the bank for any / all of the following reasons ?  
a). Not ensuring proper security against such fraud transactions (a credit card can be very easily misused as you can do a number online transactions with just the and number, expiry date and cvv number at the back which can
be easily taken down when you use your card at a retaurant / petrol pump etc.)
 
b). Not ensuring proper customer support as i was assured that the matter will be resolved by now.  
 
c). For causing me unnecessary mental stress and agony as the amount involved is considerably high for a working middle class citizen like me. 

Any advise on the above matter shall be greatly appreciated.

Subject: Financial Fraud.

Dear Sir, my dad invested in sahara finance housing development project in ranchi,jharkhand in the year of 2003-4 for a period of two years. The investment was to be used by sahara to bring up apartments, but they decided not to built any. later after the end of two years tenure, when he asked for payment, the  company said it has already  transferred the money in some other investment portfolio, which was way riskier than the present one, and that even without our permission.

Now the investement of approx 2 lakhs seems to go in vain as they have even stopped to respond to our complaints.Their regional staff know nothing. Please advice what to do.

I have purchased a product describing it as NATURA. At the first instance of looking the product i thought it is a product manufactured from natural ingredients, but later i was shocked to know that the product is made of
artificial substances. Please advice me how to take legal action for misrepresentation by the manufacturer.

Myself Shivam Kumar residence of Lakshmi Nagar, New Delhi. I have a connection of MTNL broadband connection. For last seven days i am not able to connect with my broadband. In between i had registered my complaint 3
times. But there is no reply from MTNL. The service is still interrupted.

Im using a mtnl broadband connection from jan,2008, from the first date my connection was not stable but somehow im using the connection. Because i don’t aware about consumer power, but now they people harressing
me when i say them to return my installation charges and atleast 40% of my monthly rent. From feb,2008 my connection even wrose, at a time i can use only one thing my landline or my broadband and they people are saying that sir your home is too far from exchange and it will be same im suffring badly from 1.5 years please suggest me what to do.

Complain against your authorized dist M/s Balaji Motors Thane for Cheating on Purchase of Indica Vista Aura Quadrajet This is to bring to your notice that I have purchased Indica VISTA AURA Quadrajet from M/s Balaji Motors Thane on 13th April 2009 for INR 456803/- Vide Invoice # BLjcpl-BS1-0809-00454 dated 25/3/2009.

Car Details are as:  Engin / Chassis # 04364/ 13778

Durring Purchase of Car following Price bifferfication was given explained to me :

Surpriseingly when I received the Orginal Invoice of Octroi / Registeration Charges & Insurance from Relaince I was shocked to observe following difference which were overcharged

I went back to Balaji Motors & spoke to there officials including there General Manager Mr Gautam regarding the descripancies . He had follwing statement to make: 

 Tata gives 0% Commision on Indica VISTA Quadrajet

What ever freebees ( anti rusting / Mats / Polish Coating / Mudflaps ) he has given , all ISTRIBUTORS takes out Money by Overchargeing from these Regn / Insurance / Octroi amount only.

As per him this is very transparent deal which all distbutors across Mumbai are implementing & these all things are never clearly told to Customer This is PURE Paper CHEATING !!!

If these were made clear to me I would have personally got Regestiration / Octroi Clearance / Insurance done to Cleanly save amount of INR 16461 /- ( Sixteen thousand four hundred & sixty One rupees )

Requested to Immediately look in to same & take action against your authorized distributor & refund me my hard earned Money.

Subject: Real Estate

I had invested 2.75 lacks as a pre launch booking in Omaxe Construction company at Bhiwari ( Rajasthan )arround 3 years ago. As per terms and condition of Omaxe if they  fail to provide a unit allocation within one years they will refund booking amount with 9 % interest . The launch was delayed for more than one year and now when  Iam asking for refund of my money they are telling that at this moment company is not refunding money and it is for some period of time. Please suggest how to get refund of money

Subject: quality of Panasonic Viera T.V purchased poor

I am unsure of how to proceed and so am seeking advice/help.

My problem is:
I bought a 42″ Panasonic plasma Viera (TH-42PA60H) T.V. on July 6 2007 in Noida for Rs73000/-.  I had expected the T.V to work at least 10 yrs (the previous LG T.V worked without problems for 15 yrs).  On July 25 2008 (exactly 3 weeks after warranty got over) the T.V suddenly stopped working.  After 2 months of being under repair/observation, a microprocessor card on T.V was replaced at the cost of Rs7000/- to me.  No explanation given as to  why the card failed.  Now after 8 months again the T.V stopped working suddenly.  We are a 3 member family and the T.V is mostly used on weekends and holidays – most of the day no one’s home.  We have contacted the  Panasonic repair centre – they would be taking the T.V away for another expensive repair. 

Since my T.V is on a voltage stabilizer, the T.V internal power supply system is intact & functional, and probably  another of the cards inside would need to be replaced. I am convinced that this T.V is not of good quality.  One of the reason cited for T.V failure is humidity.  Since Panasonic is selling the T.V in India, I am sure they must have accounted for the hot/humid factor. My T.V met all the operating conditions as specified in the manual.

I feel cheated. I want Panasonic to replace the model with a good equivalent one or repay me the price of T.V and service (and take away the T.V).

Please advice me on how to go about aproaching the conumer court/forum and how to proceed.

No Power supply and regular breakdowns for almost 15 to 24 hrs. This is regarding very very poor power supply by BSES Yamuna in my area. After being disappointed by every higher authority, I have wrtten following
email to ceo@bsesdelhi.com – here is the email 

Hi Sir / Ma’m,

This is being a long time that I am raising this concern and registering the
complaints to consumer help line of BSES Yamuna (011-39999808).
This is regarding the regular breakdowns in my area.

I am a resident of D2/323, Street No.-6, Near 4th Pushta, Sonia Vihar, Delhi
- 110094. There is very very poor power supply in our area.
This is being almost two to three months that I am raising a concern.
Whenever, I will contact consumer help line for power cut, I will be
informed that there is either ST Cable fault or LT Cable fault. I am told
that it takes almost 2 to 3 hrs. to rectify these faults. However, when it
happens in my area it takes approximately

15-20 Hrs. Also, once it happened
that I was told at 10:00 p.m. that electricity will be normal after 1 Hr.as
the maintenance is being done.. when it did not happened and I call next
morning. I was told as no maintenance work was done whole night it is not
yet rectified and will take another 4 hrs. for this. It means the
verification deptt is also not providing the true information.

After getting so disappointed with this I requested Mr. Sharma, who is the
head of maintenance deptt. for my area on phone call. He told me that if you
have registered a complaint this is enough you can do.
On this response, I requested Mr. David Roy of Customer Help Line to please
forward this request to higher authorities. He did so twice, as he told me.
And yesterday also there was a breakdown in my area for almost 15-16 hrs.

Initially whenever there is a power cut in my street, it was supposed to be
with D1 block and now it is being done with

D1 and E both. It means if any
of the area is under break down Street No. 6 will be without electricity.
Also, there are cases that whole Sonia Vihar has electricity except Street
No. 6 of block – D2 and the reason – BREAKDOWN. Please note that I have
never seen even a single person doing maintenance work in my street. Also,
automatically without any maintenance power will be supplied.

I don’t have the list of complaint Numbers with me right now. You can find
out them if you will see the prior history on the CRN no – 1251170397 (This
meter is on name of my father). You will get at least 15-20 complaints for
breakdowns and long power cuts within last 2 to 3 months. All this is
happening in addition to normal power cuts of almost 9-10 hrs. on daily
basis. A news of at least 2 breakdowns within a single week for a period of
15 to 24 hrs. is very much normal for me to listen.

Request you to please look into the matter personally and take necessary
actions in this regards.
