    Dear Sir,

    I have a retail shop of Sarees in mumbai, I always purchase sarees from Surat, I purchased sarees of approx Rs:-33,000/-(Total Bill) on Feb 2011 from a party via a broker,and I had given 3 undated cheques as security to that party, in the month of Aug 2011, broker visited my shop and he demanded that money in cash….on my companies letter head dated 28/08/2011, i wrote a letter to the party that I am handling Rs:-33,000/- in cash to the broker , hence return all 3 undated cheques….the broker even did his signature on it that he has received cash and he took the original copy with him I kept the photo copy of it….within this period I did not receive any call from the party for demanding the money from me…I thought the broker would have handed over the cash to the party and party would send me the security cheque’s via courier asap….

    On 29/04/2012 when I visited my bank…I came to know that the party had deposited all the 3 cheques and cheques were bounced

    Today(30/04/2012) after approx after a year I received a notice from a lawyer from PUNE on behalf of that party in SURAT demanding Rs:-33,000/- within 15days…

    Request you to kindly help me as to what can be done in this case….as I have already made the payment of that parties outstanding bill to the broker

    Dear Concern,

    I had an insurance in ICICI Lombard (medical insurance), now in the month of january i had suffered from DVT Thrombosis so i got admitted in SAL hospital Ahmedabad, Now before taking insurance i had conducted all the test required for the Medical insurance all was normal,Previous year i had done my routine check up of heart by C T imaging (which is only imaginery approximation can not be trusted) in that we supect there is blockage in the ancillery veins of the heart so we concerned the expert doctors they advised that it is normal you will found this kind of thing in most of the person who is plus 45 years , so you need not to worry your report is absolutely normal,

    But now at the time of claim of my medical tratment of DVT the insurance people said you had pre heart diesease and you hidden it so your claim is not accepted, so wehad perfom physical angiography so justify the same in that also doctor said the same is called as normal , but the insurance people are saying that this is disease so your calim is rejected .

    Please help me what can be done in this case

    I have given my HP Laptop (Model No.- DV5-1104TV, Sr. No. – CNF8491PG1) for servicing of
    problem screen blinking problem dated 11/02/2012. But the problem was sorted temporarily. After one month , the problem was reoccured. when we went to complain about this to HP service centre in Noida branch address:

    ELITE BUSINESS MACHINES PVT. LTD.
    B-106, SECTOR-64, NOIDA 301201 (U.P.)

    they again asked for the service charge (500/- ) and given the very negative response.

    This screen blinking problem is very general in the HP DV5 Modal laptop. My some friends also suffer this issue in their laptop.

    I have told them that problem was occurring from the next day of servicing but i was out of station. i was try to call to the office number. But the Telephone number was not reachable. that’s why i was not able to complain that time.

    When i have to meet the service manager, he was response very aggressively and he was not listen us and argued that we could impose some extra charge when we servicing the laptop. This shows their service is totally fake.

    We take one shop on rent in Seawoods but till now owner is not giving our money which we spent on electric meter,water meter.As per agreement he should pay that amount .Now he gave shop to Subway on rent.Our goods are also there they are not allowing to take our stuff.Pls advise.

    We purchased the above TV from Sony Center at Viraj Corner, Sharanpur Road, Nasik on 17th Oct 2011.

    Right from the beginning this unit was giving problems & it was informed to Sony Center.

    1) Double images in the picture as well as in letters.

    2) In certain cases the picture was waving & fluctuating.

    These problems were shown to thier representative. On his request we got the cable signal improved but the problem persisted & also the problems were not appearing on another LCD TV working on same signal next door to us.

    However on his insistence we purchased Airtel Dish with a set top box. All the efforts the quality & clarity of picture improved but the problem did remained and we were not satisfied.

    We requested at the same time to give replacement but it did not happen.

    Now finally after five months the whole picture has become dead with black strip and we are advised now that some T.CON PCB will have to be called from Singapore and replaced.

    We insisted to Sony India that this particular unit is of inferior quality, defective and problematic from the beginning & we request to give replacement of the unit so that our confidence & faith is restored in them.

    But Sony India is not ready to give a replacement, and insisting on repairs, why we should have a TV which is giving problem from day one. can consumer has any legal right to complaint regarding this & protect our right to have quality product ? Please reply if have any law regarding this.

    This is regarding a fraud related to the website “www.dealbeal.com”. A representative (have the number and name) from the dealbeal visited our society in Rohini and sold us 2 discounted coupons for a parlour “Cuts Care” in Sec 9, Rohini in Oct 11 which are valid for a year i.e. will Oct 12. When I wanted to avail the services of this parlour in Nov 11, I realized that the parlour had closed down.
    I tried to call up the dealbeal site customer care # – 9650506550 but even that was switched off. I dropped a SMS to them stating my problem but no response. I sent a mail to the owner of the site – Dinesh Karan but again no response.

    Now when I try to browse this site, it says it is not available. The company representative’s # does not get connected.

    Effectively it seems that the parlour and the “www.dealbeal.com” site owner conned people. Both of them knew that they were to close down and sold their coupons to gullible customers.

    I want to know what can be done.

    sir i have been cheated through a dealing site called 100bestdeal i played a contest on their site i won samsung galaxy phone ,apple ipod and a tablet of apple but they send me the wrist watch instead of them and that wrist watch is also not in good condition they took 1000 as a charge i want that this site should be banned and my money should be return or i should be given those things which i deserve through their contest please help me…

    Dear Sir/ Madam,

    Retail stores such as Shoppers’ Stop, Reliance Super Store, Big Bazaar, Mega Mart, Croma are charging Rs. 3/- to 5/- for pastic/ polythene bags from consumers in Mumbai. I understand the recent notification from Maharastra Pollution Control Board, where it is said to discourage the use of plastic/ polythene bags and penalty therefore.
    My question is, why do these retailers practise to provide polythene carry bags? These polythene bags can be replaced by recycled paperbags which is environment friendly and should not be charged from consumers. Do you expect consumers coming inside a mall with carry bags?
    Every part of the world, polythene bags were replaced by recycled paper bags. Why not the same is possible in Mumbai. I rekon, Delhi is more mature in this context.
    My next question is, is there any law which advocate retailers to charge for polthene carry bags and prohibit recycled paper bags

    I have shifted my daughters from Dalna Day School, Kolkata to Radcliffe School, Kolkata for the academic session 2012-2013. On applying for TC(Transfer Certificate) from Dolna Day School, the school refused to issue TC to both my daughters until we pay the full fees for the next session 2012-2013 March. School is refusing to accept the application for TC until we pay the fees for the next academic year. As TC is a must for admission to the new school so kindly advice on what should be done.

    I have my saving account in SBI Patna ,i was trying to withdraw the money from HDFC Bank Ghaziabad ,but it got failed 2 times Rs.4500/=( Total Rs- 9000/=) and i lodged the complain against this, Rs. 4500 has been returned by the bank and Rs.4500/= still is pending it is showing reversed but not added in main balance complain authority saying it has been returned to branch but branch is not responding and not returning. As i am complaining no of times by Email and online complain from 3rd of March.
    Please advice as per indian law.

    I have purchased LED TV and Refrigerator from (Croma) Star Bazar- They didnt deliver TV and Refrigerator on time but after a series of calls they have delivered but a old one with scratch.After complaining they took back and agreed to repalce with new one on another day. Its being 5 days now, there is no call nor update and no Refrigerator. I called croma service desk several times and the executives and floor supervisors are too good in playing with customer. They are not ready to escalate after 5-6 calls even not transferring to the manager.(No use even all belongs to Coma – TATA, Indias worst enterprise). Now i am forced to go to consumer court against all these people.

    Dear Concern

    I got the admission of my daughter in Mayur Public School on 27th of January 2012, meanwhile my daughter’s name come in one of the good school as compare to the exiting and I got immediately admission in 2nd school. I filed an application for cancellation of my daughter’s admission on 27th of February 2012 in Mayur Public School.

    As per DOE circular if we file an application with in 1 month from the date of admission then the fee is refundable. I file my application on 27th of February because on 26th there was sunday.

    As per my understanding if we calculate 30 dayes from the date of admission it comes 0n 26th but on that day there was holiday, so the last day of filling of cancellation application is on 27th as same calculation is if we calculate on with in one month.

    When I visited to the school they simply said that you filed your application with in 32 days that’s why you are not eligible for getting refund. when I ask these things in writing they denied.

    I request you to please suggest me on this issue.

    I have activated internet services on my airtel number at around 11:48pm on 23-03-2012 and the GPRS Plan was @Rs10 (100mb/day).Immediately after that I have received a confirmation message from airtel and my balance was around 170 rupees ,but i was unable to surf and i have contacted airtel customer care (121) regarding the problem at 11:54 & 11:58pm respectively and they asked me to clear the cache memory, restart my mobile. After this complete procedure i was able to surf and i continued to use the gprs service. But at around 12:50am my mobile started to show zero balance, which was earlier around Rs170/- after activation of gprs pack.While I was having an very important conversation with abroad MBA college regarding my admission.

    I tried to contact customer care and due to low balance it refused to connect, immediately i have transferred Rs5/- at around 12:54am from another airtel mobile and made a call to customer care number 12118 at first some lady spoked to me and further she said she would transfer to the possible higher authority availabe and they discontinued the call. I again called to customer care number 12118 at around 12:59 and Mr.Satyan Narayana spoke to me saying that ” the gprs pack that i have activated was valid only for one day it ended at 11:59pm of 23-03-2012 itself and what ever i have browsed after 12′o clock was charged from my main account balance.”
    when i asked him to connect my call to higher authority he said my account information will be only available at 121 & advised me to call that number.

    I have immediately called again to 121 at around 01:08am and I explained Mr.Anil the earlier conversation that i had & I informed him that earlier also i have used gprs services on airtel and 1 day stands for 24 hrs from the time of activation and does’nt mean till the night 12′o clock. further he informed that he would place an complaint letter and i will receive the complaint refernce number within 15 mins.
    But i waited for 1hr and did’nt received any message regarding the complaint.I made another call to the customer care and in return he blamed me and out of low balance my call got disconnected. In morning i made another call to customer care and they said they would connect my call to higher authority and they kept me in waiting for around 12mins and again disconnected the call…….,further I recieved a message stating that the service would get auto renewl within 24hrs from the time of activation i have done earlier.

    Even I have’nt recieved any information or a message at 12′o that my prior service got ended.Due to this stuff I missed my important conversation at middle with an uniersity prof.
    I hereby want to lay an complaint regarding the cheating that airtel subjecting saying 100mb/1day@10Rs/- to its customer and cheating people with fake advertisements.

    My Iomega 320Gb external hard disk stopped working. I gave it to the shopkeeper from where i bought it on 20/12/11 for replacement. He forwarded it to Nutrick Technologies, Ghaziabad who in turn forwarded to Iomega Center, Bangalore. Its been 3months today that my hard disk hasn`t been replaced yet. They are saying that it isn`t in our stock due to flood in Taiwan. They are asking me to take refund of it i.e around Rs.2500 only or pay Rs.2000 more to get 1Tb hard disk. I bought my hard disk for Rs.2950 2years back and presently its cost is around Rs.3500. I am repenting on my decision to buy Iomega hard disk. I want that the company should give me new 320gb hard disk ASAP or another hard disk of more capacity free of cost. Why should i suffer. My bill details are-

    I booked a 3 BHK (1675) flat through a dealer (KALRA REALTORS in Barakhamba Road & Nehru Place) in September 2011. This dealer offered me an upfront discount of 5% on Basic Sale Price (BSP) of 3095 per sq. ft. Hence the BSP after discount was 2940 per sq. ft. I DID NOT EVEN BARGAIN for this rate, hoping that this dealer will cooperate properly.

    So I send them the BLUE application form (dated September 2011) along with ALL the required documents and the initial booking cheque of 5 lacs (also dated September 2011). My cheque was cleared in the first week of October 2011. This application form clearly showed the rate of 2,940 and ALL the amount calculations in the form were based on this rate.

    Once my cheque got cleared, this dealer completely changed his face. He did not gave me the acknowledgement of the application form and neither gave his credit note (of 5% upfront discount as he offered). Finally after lots of convincing & requests (for this even my father went to his office several times), he gave the credit note of 3% direct discount & 2% dealer discount. Now you can imagine what does this dealer discount means (chase him again and again, even though I am paying the money) ?

    Then finally on 16 January 2012, I received the acknowledgment of this application form. And to my surprise, it was NOT stamped by Kalra Realtors, but by another sub-broker named MNC PROPMART in Gurgaon. Actually this was to defend Kalra Realtors from any legal implications.

    Then on 30 January 2012, the first demand letter was issued to me by Ansal Housing & Construction Ltd. And on this letter, the last date of payment had already passed (29 January 2012). And again to my surprise, Ansal Housing charged me at the BSP of 3,145 (which was 50/- more than what was stamped in the application form and the attached Annexure) and with discount of 3% only (due to the credit note offered by Kalra Realtors).

    By this time, I had already paid more then 12% of the cost of the flat.

    Now here the fraud is not only done by the dealers (Kalra Realtors & sub-broker MNC Propmart) but also by the builder ANSAL HOUSING.

    -> On their application form, it is clearly mentioned that Ansal Housing will NOT accept ANY payment without acknowledging the application form. Then how can Ansal Housing accept the initial booking payment without agreeing on the rate mentioned in the stamped application form ?

    -> The dealer (Kalra Realtors) told me that if I do not accept his credit note (including 2% dealer discount) then my booking would be cancelled whereby I will have to bear the heavy penalty of 20% from Ansal Housing, which means my entire amount paid (12%) would be forfeited.

    Now the options I have are,

    1. Try to find a way with the dealers (Kalra Realtors & MNC Propmart) & Ansals to rectify the wrong that has been done. And for this,

    a) First issue a notice to the dealers & Ansal in a consumer forum ?

    b) Then issue a legal notice to the broker/Ansal after consulting a legal advisor / lawyer.

    c) If still they do not rectify the price then take them to the court. But this will be an expensive and lengthy process.

    2. To accept this fraud and keep paying at the higher price (as increased by Ansals) & forget the dealer discount (of 2% as per the credit note by Kalra Realtors). Now here there are 2 possibilities,

    a) I keep the flat after possession also (because of good future prospects). But then what is the guarantee that I will not face problems from Ansals or their dealers i.e. Kalra Realtors & MNC Propmart. I read someone’s post against Ansal API (the other Ansal group) for cheating during possession time by asking to pay more money (because the market price had increased).

    b) I take the allotment of this flat (after paying 35% of the entire cost) and then try to sell it in the resale market. But then what is the assurance that I will get a nice unit after allotment. When the price in the stamped application form itself is not valid for Ansal Housing & their dealers, then what will they bother about the flat preferences as requested in the same application form ? If they give me a least preferable unit (like top floor or pathetic view or the worst location etc.), then how will I sell it in the resale market ?

    PLEASE GUIDE,

    - Which option should I opt for ? Am I missing anything here ?

    - How to issue a notice in a consumer forum to the builder (Ansal Housing) or the brokers (Kalra Realtors or MNC Propmart) ?

    Thanks in advance for giving me your ideas, suggestions and information. I hope that I come out of this trap.

    1. Try to find a way with the dealers (Kalra Realtors & MNC Propmart) & Ansals to rectify the wrong that has been done. And for this,

    a) First issue a notice to the dealers & Ansal in a consumer forum ?

    b) Then issue a legal notice to the broker/Ansal after consulting a legal advisor / lawyer.

    c) If still they do not rectify the price then take them to the court. But this will be an expensive and lengthy process.

    2. To accept this fraud and keep paying at the higher price (as increased by Ansals) & forget the dealer discount (of 2% as per the credit note by Kalra Realtors). Now here there are 2 possibilities,

    a) I keep the flat after possession also (because of good future prospects). But then what is the guarantee that I will not face problems from Ansals or their dealers i.e. Kalra Realtors & MNC Propmart. I read someone’s post against Ansal API (the other Ansal group) for cheating during possession time by asking to pay more money (because the market price had increased).

    b) I take the allotment of this flat (after paying 35% of the entire cost) and then try to sell it in the resale market. But then what is the assurance that I will get a nice unit after allotment. When the price in the stamped application form itself is not valid for Ansal Housing & their dealers, then what will they bother about the flat preferences as requested in the same application form ? If they give me a least preferable unit (like top floor or pathetic view or the worst location etc.), then how will I sell it in the resale market ?

    PLEASE GUIDE,

    - Which option should I opt for ? Am I missing anything here ?

    - How to issue a notice in a consumer forum to the builder (Ansal Housing) or the brokers (Kalra Realtors or MNC Propmart) ?

    I have bought a phone and due to its very frequent prob;ems i have returned for replacement. the company agreed to give me another phone of a different model but it has been 45days and more but they have not promised any time frame when my phone will arrive. They say they have to transport it from Noida but it is 10days since they said that !! What should i do ?? How long is the max period for replacement cases according to the Indian law ???
