I am Harichand from aurangabad( palwal) . I want to open accounts of me and my friend and for this i went to idbi palwal branch.I met there to staff and they told me the whole process .I submit the documents to a sales executive and gave two checks of 2.5 lakhs. But after ten days manager of that branch denied to open that account even i fulfill all the conditions .They told the sales executive that we can’t open the account at zero balance if there is any problem in opening my account then they can told me the same day.After this ,i gave them cash of 30,000 rupees,but still they create a problem.Now what can i do for this.It’s a big loss for me because interest of five lakhs rupees are not less and my work has also spoiled.Their behaviour were not also good ,they also threatened me after i complaint against them to idbi authorities.But they also not take any action against them.Please tell me what i can do

I am holding a Mediclaim policy (Floater policy)with Oriental Insurance comapny since March 2010. In this policy my Parents are covered with me.
In month of August 2011 my father has suffered by some chest pain due to this he was admitted in hospital for 4-5 days and he went threw Angiography & other check up.
But after submition of all the document, Insuarance company has rejected my claim by metiontioning – Claim has been rejected due to a hypertention and hypertention deaseas will be covered after completeing 2 years policy.
Doctor might have mention some acidity and hypertention problem in the report.My father is aged with 55 years old and never been to any type of such incident.
Please guide.

I had an agreementin Nov 2007 with Mrs Aiswarya Royals Developers Bangalore, to purchase a site at Chikkaballapura and paid Rs.156000 as advance.
Agreement states that if site is not registered to me, the advance amount has to be refunded to me with prevailing bank rate of interest.

Subsequently ,neither registered me a site nor refunded the amount. After repeated demand, the partners gave me a cheque for Rs.156000/- on 30.4.2009, but the same was bouced for not having sufficient funds.

Then I filed a criminal case against them in Tiptur Court. In Oct 2011 , the partners paid me Rs.156000/-.

1-dec-2011 at 7.00pm i was used icici bank atm at S.G.Highway with ‘ATM no- S1CW5271′ for transanction with my SBI atm card, i was make 1600 Rs.trans. But that time on transatction receipt saw your ‘TRANSACTION DECLINED’ UNABLE TO PROCESS,and i not get money, again same as i was try for 1600Rs trans. But same happen i get receipt that your ‘TRANSACTION DECLINED’ and i not get money than after 20minute i received only one sms from SBI that saw me your card was used fos 1600rs withdrawing, therefor i again went to same icici atm and chek my balance that time i again get receipt your ‘TRANSACTION DECLINED’
than i chek my acount balance on My Mobile Banking, and i found 1600Rs and 1600Rs two time debit total 3200RS debit from my acount. Than i try all SBI curtomer number but all number is saw me busy i try from my mobile and bsnl landline for caling customer care but i will not success. Now please help me for solve my this problem.

I am a Sahara Care House member and as such I have been provided with a medical insurance with Alankit TPA Health Care Ltd. In the month of August, 2011 I was admitted to the Apollo Hospitals, Chennai and within time period I have applied for the cashless facility and on 2nd August 2011 it was informed that cashless facility was not allowed or policy clause 4.1 which speaks for pre-existing disease. In the denial letter it was also mentioned that I can put my
claim for reimbursement which will be resoved as per the terms and conditions after getting discharged. After I was discharged, I made a reimbursement claim to the Alankit TPA Health Care Ltd. but after few days it was informed that my reimbursement claim was also not allowed for pre-existing disease.
Now my question is if the said insurance company already knew that the patient is suffering from pre-existing disease while denying the cashless facility, for what reason they have mentioned in the said denial letter that I can claim for reimbursement. It was the reimbursement clause in the denial letter, after seeing which I decided to stay in Apollo Hospitals, Chennai, otherwise I could have opted out from the hospital as it was getting costlier for me, but still I continued my treatment there as because I thought I have option available through the reimbursement claim.
Is there any possibility of getting through the reimbursement claim?

Sir I purchased a whirlpool frontloading washing machine from a dealer named ‘Priya Refrigration’. He is selling fectory scretched pieces at a lower price. He is giving warranty for 6 months. After delivery, First day onwards machine was showing defect codes. I told this problem to Dealer. He assured me to send a tecnician within two three days. But he did not. Then he started giving excuse that part is not avlable. Now 2 months passed. After giving so many phone calls every time I am getting same excuse. Now please suggest me how I can approch to consumer court for legal action. I have never visited court before.
This machine is costing 14,500/- only and can be repaired inbetween 5,000/-. What will be the fee of lawer in consumer court.

Dear Sir

With due respect, I would like to inform that I booked a flat in Kolkata around December 2006 from a real estate developer and per sale agreement I made all payment on or before the due date.
I would like to inform you the following:
1. The sale agreement specifies that the flat shall be completed by 31st December 2009 and while asking for delay compensation, if any, a separate letter was issued (on company letter head) by the developer that we will be compensated @ Rs 5 per sq ft per month from 1st January 2010. Now the developer is handing over the pocession letter, but while asking for compensation refuse to acknowledge that letter.
2. Govt imposed service tax applicable on our payment made after 1st July 2010. While asking the developer that service tax is applicable because of delay by the developer, another letter was issued stating that the service tax shall be brone by the developer. Now while taking pocession letter, the developer is refusing to acknowledge the letter and forcing us to pay service tax.
I seek your advice with respect to following:
1. To whom Can I lodge complain (RTI or Consumer court) on this subject against the developer?
2. If I can lodge complain then to whom I should address our complain in Kolkata?

Your advice shall be very helpful.

This is a compalint about my father’s Death claim which was being handled by 12B Jasola branch in new delhi..My father’s death happend on 28th Nov, 2010 and now it has been many months that we are running after my father’s case in LIC offices every now and then.On september 14 th2011, LIC informed us that our Policy #122339538 has been rejected because on 2008 my father had an operation for his pancreas and during that time we were not paying his premiums due to some financial problems.. However we got the rejection letter by the agent 10-15 days after it was rejected.When my father became fit after the operation, we filled a revival LIC form and started paying premiums again. on the revival form our LIC agent Umesh Singh misguided us and told us not mention about the opeartion as the claim will be rejected whenver we will try to claim and he got that form signed from my father LT.Sh. Sunder Raj. LIC now is rejecting the claim with the reason that we didnt inform them about the operationin on the revival papers in 2008. We were misguided by an insurance agent by LIC only.
My father never died because of that operation, he died because of tuberclousis according to the last medical papers at the time of his death. please advise urgently as why they have a reason for rejecting the case now because of something incorrect happened in 2008 by their agent, the cause of my father’s death was never the operation , it was due to tuberclosis.We never got any cooperation in LIC jasola and laxmi nagar offices in new delhi.This policy got opened on 11/08/2003. On the letter it is written we can forward this case for reconsideration within 3 months from sept 14th,2011,if we think they missed something. please call me,email me or advise me urggently what to do…

My mother bought a flat in 2nd floor of a building with a sanctioned plan upto 3rd floor.He did not raise the 3rd floor. He also did not do the required treatment on the roof of our flat as that had become the roof in the incomplete building.As a result rain water seeped into our flat walls and ceiling damaging beams and walls. Urgent repairs had to be done to protect the flat from further damage.
Sought compensation for reimbursement of already incurred repair and further appropriate repair on roof to stop seepage of water into the flat
The original owner my mother died before filing case and the present case filed by my sister who inherited the flat and her brother. Please advise if the case can be taken up and eligible under CPA and under which section.

I Bought Bajaj Mega Auto (TN AC 4880) 15 months ago. My Auto tire(left back side tire) was worn down unreasonably. So i complained about it in Service station. Still now That problem was unsolved. I complained about it four times up to now.

I had booked flight for 6 family members to Mumbai enroute to a vacation abroad on 30th Oct. the flight departure time on ticket was 18:35. I and family reported to desk at 17.25 but were told that we were late and boarding was closed. My complaint to Kingfisher drew reply that boarding closed at 17.45 and I was late. I have proof in form of my detailed phone billing recording that I was there well before close of boarding. I missed that flight and consequently the entire foreign vacation.

I intend to lodge my claim against illegal withdrawal of Rs. 33000/- from my SBI Savings Account thru SBI-ATM occurred on 24/10/11. I came to know about the same on 01/11/11 when I visited the SBI ATM to withdraw money against my monthly house rent. The ATM Room consisted of 2 ATMs. The left side ATM showed & issued slip of “Sorry unable to process your request” at about 8.23 pm, while I requested for withdrawal of Rs. 100/- only on 24/10, taking time I moved on to the right side ATM wherefrom I successfully withdrew Rs. 100/- at 8.25 pm. Now, the machine which was malfunctioning was used by unfair means to
draw money at 8.29 pm from my account by another person which is evident from the video footage recovered by the Police on the basis of FIR lodged by me. I need your advise in this regard.

I have win a bid for property auctioned by bank, that property is covered under rules of PUDA. While granting loan bank was needed to record “Permission to mortgage” but bank never accorded its lien mark on property in PUDA record. Now at the time of sale of property by bank, PUDA is denying NOC to sell that property, bank is saying its has sufficient power to sell the property. now in this, i found myself in mess, as i can not further dispose off or make registry on behalf of Sales letter issued by bank without getting the NOC from PUDA. What shoud I do, please Advise ?

I’m Deepak Singh, From East Delhi. I bought a Maruti Esteem in 2002 and got it alongwith rattle sound in Suspension. approached the Dealer, i.e Batra Auto Company(Faridabad) and Maruti Udyog too.
But all in vain.

Finally, In 2004 I filed a complaint to Consumer District Forum-New Delhi(Barracks, K.G.Marg) and the order for the case was reserved 0n 20 October 2009.
But till date i’ve not recieved any acknowledgement of it from my Lawyer or Court.
I’m afraid that wait of all those years might go in vain, as my lawyer isn’t ready to return my original papers of the case and court says wait.
I think that der or andher dono he hain.

Dear Sir, In the month of September 2011, I have serviced my 4 wheeler and after few days of service (barely drived for 100 Kms), I faced the problem in my ignition due to which, my vehicle was not getting started. (The same complaint I did in my last two servicing but it was not taken care of).After the problem was rectified (on Friday), I barely drived the car for around 20 Kms and parked it in front of my residence. Within 15 Minutes of my parking, the car caught fire due to which, the complete engine portion burnt out. Now, after doing regerous fight with the service station and Tata Motors (without any result), the service station is asking me to deposit Rs. 40,000 so that the car can be repaired. They are pressurising me and giving multiple reasons and actons if I don’t pay the amount in advance. I am a salarid person whose budget is a running cost in every month. I don’t have any doors to knock so I am knocking your door so that the problem can be sorted out.

Hello,I am a student of National Institute of Pharmaceutical Education and Research (NIPER, Kolkata) and I need your help. I need to know whether false claims by an Educational Institution regarding placements is covered under Consumer Protection Act, when student is paying Fee specially for Placements ?

At first glance it appears as Institution is asking Charges for Service (Placement) but they are not delivering it.
My senior batch paid Rs 2500 each for the placements in Final semester but out for 50 students only 3 got the Campus Placements and those placements which occured were in completly unrelated fields opposed to the specialization of the candidates.
One more question…Where to complain regarding the corruption in Central Government Educational Institutions ?

It is now 25 days passed, i had purchased “Godrej Refrigerator” from Snehanjali Mall Kandivali (w). I found the Refrigerator with faulty Bottle Shelve a the time of delivery, the delivery person told you have to contact the Shop from where you had purchased. I called the person of Snehanjali Mall and told the problem about the refrigerator, he told me it would be fine in 2 days, as godrej demo person will come and fix it. No person came. after calling regular to
the Snehanjali Mall they told that Godrej Service center will handle the problem, gave me the customer care number and told to contact them.

from that day i am calling Godrej Service Center and Godrej Head Office i am been told it would come in 2 days, next days and so on.
kindly help me.

Shifting of landline connections given to Airtel on 19th June via email. Mail was sent to 121@airtel.in. No reply was received from them till 28th of June. So a reminder mail was sent on 28th of June to same address. Got a reply on 29th of June and was given request number 440962 and was informed my concern would be resolved soon. I called up customer care 44444121 during next one week almost everyday but no one gave me the status. Everytime I called they said
they will get back to me and the matter is under process. Then I get a call stating that my line is under cancellation process as per my request and would be deactivated. I informed the person that I have placed the call for shifting and not deactivation. To which I was told they would resolve the error and the line will be shifted.
Finally I received a call from their shifting department and was informed that since they did not have the copper wire for shifting they are unable to shift the line, and I should arrange my own wire. I arranged my own wire and got the shifting done.

On 11th of July I get a call from Airtel Safdarjung office stating that there are no points available so they cannot activate the line. I told them if shifting was not possible how come the wiring was done. I was informed that there seems to be some error in the system and they will check and call me back.

I sent an email stating the above facts to 121@airtel.in and also to appellate.ncr@airtel.in .I got a reply from the appellate stating due to technical error they can not shift the connection . (Please note wiring was already done by Airtel.)

I wrote back to appellate asking if it was not possible why was wiring done and in return I got a mail stating they have put my line for cancellation and the request number for it is 1533788.
Then all of a sudden the line started working and it worked for two days and post that the services got barred. I called up customer care and asked the reason and was told that due to non payment services are barred and if I make the payment the services would get activated.

So I made a payment of Rs. 870 at the Airtel outlet and scanned the receipt and mailed it to 121@airtel.in on 18th of July.
They said the system is under upgradation and services would be restored by 30th of July. The reference number for the same was given as 49057348.

I sent a reminder to them on 121@airtel.in on 25th of July asking for status and they gave me a new request number 1192642 and told it would take 18 days to get my shifting to be done. I wrote back stating shifting is already done, Dialtone is there in the phone however incoming, outgoing phone and internet services are barred and need to be resolved.

They replied back with another ticket number 1302716 and said services would be activated by 27th July.

Nothing happened till 28th so I sent an email asking for status. To which the response was that my concern is being looked into on a priority basis and will be resolved at the earliest.

Then I wrote to ap@trai.gov.in with cc to nodalofficer.del@airtel.in, appellate.ncr@airtel.in, 121@airtel.in, nodal.ncr@airtel.in, care.ncr@airtel.in. Detailing the issue.
I would like to mention that during this email communication I had called up the customer care number 44444121 and the appelate authority number many a times however I got the same answer that the concern is on priorty. To my surprise the applleate autohrity number was mapped to customer care. This came as a shock to me as the person I spoke to on customer care was the same when i called up the appellate authority number.

On 30th July I got an email from 121@airtel.in stating my services has been restored. When I checked there was no dialtone, no outgoing and no incoming service. When anyone dialled my number they got the message that the number is out of service.

I wrote back to 121@airtel.in stating the above mentioned fact on 30th July and got a reply on 31st July stating that my concerned would be resolved by 1st of August and again got another request number 1589554.

I did not hear from them so I mailed them again on 8th of August 2011 for status and was informed that my services have been restored on 6th of August 2011.

I replied back stating its still not working and am still getting error out of service. They again registered the concern and another ticket number 1645050.

I did not receive any response there after so I called up the customer care and again another service request 2217446 which was given to me on 12th of August.

I sent a reminder mail on 16th pf August and got an email stating my concern would be resolved by 20th of august. When I asked for status I was told issue is resolved. However I did not get any dialtone on phone and no incoming and outgoing. Mean while people dialing the number kept getting the message phone is out of service.

Then I spoke to the appellate authority on phone on 10th of Oct (luckily this time the call was not getting routed to customer care).

The people kept putting me on hold on pretext of finding information and then the call kept disconnect after being on hold for more than an hour. So on 11th of Oct I asked them that I want to speak only to the Appellate authority and they said he is not available on the phone and if I need to talk to him I need to visit to him in person. When I asked for the address they told him I could meet him at Airtel Broadband & Telemedia Services Ltd. Delhi Bharti Airtel 224, Okhla Industrial Area Phase – 3 110020.

So I drove to Okhla in hope of getting the issue resolved. However at Okhla I was told that Appellate authority is not available at the office and I need to call up the appellate authority phone number to get the phone number.
When I explained the reason why I landed up they directed me to the customer service department located at Airtel Broadband & Telemedia Services Ltd. Delhi Bharti Airtel 224, Okhla Industrial Area Phase – 3 110020.
There I was greeted with with Ms. Preeti with whom I shared my concern she patiently heard my concern noted it down and handed me a complaint number 5414906 with the assurance that the line would be working very soon.

Nothing happened and then I wrote to appellate again on 27th Oct asking status on my line. In return I got a call from Mr, Sanjay on 8th of November from Appellate Authority and I shared my concern with him. He assured me that the issue would be resolved in next 12 working hours and I need not worry. He then also sent me an email confirming the same and also shared a tikcet number 6957194. However my issue still remain unresolved. And anyone calling up the
number still get the message number is temporarily out of service.
On 18th of November Mr. Sanjay from appellate had called up again and asked me if the issue has been resolved yet. I told him it has not and he assured me it would be resolved by Saturday. When it did not get resolved I wrote to them on Satruday again asking for status. But no reply, Again I sent em an email on Monday 21st Nov and no revert. A reminder again was sent on 22nd but no revert.
Today 23rd of Nov I have got an SMS stating that my call has been lodged via reference np 7708618 and they would get back to me by 26th of Nov.

The delay has caused me huge loss in terms of spending money on cyber cafe. Also since I am a networking professional I need to work late hours at times from my house however in absence of the internet service and no clear answer from Airtel I am forced to travel to office many a times. Hence I need a suitable compensation from Airtel too.

Sir,
I have purchased a flat in Mumbai suburb, Mira Road, in the year August 2008, by paying a sum of Rs.20,00,000/-(Rs. Twenty lac only). The total value of the flat was 25,11,000/- which was paid full and final in 2010 and an agreement of sale was registered at the sub registrar at Thane in October 2010. But still the builder did not hand over the possession and asked for an amount of Rs. 3,00,000/- as parking space(this was never mentioned earlier anywhere), hence I had no option but to approach a lawyer to register a case in the consumer court against the builder M/s Ravi Developers.
I approached the lawyer in the month of August, 2011 and he said he will file a case, which he took 3 months to file it. He has already taken more than 50% of his fees from me. But he has not given me a copy of proof that the case has been registered. Every time he has a different and vague answer. He just said that your case no. is 2014 and the first hearing will be on 28th November, 2011. When I repeteadly asked him about the same he said that the court does not
give any proof, you will get a copy on the date of hearing. I am having serious doubt whether he is hand in glove with the builder, and whether he will be present in court on the appointed day.
Sir, I just have 5 days now and really do not know what is happening. The case has been registered in Consumer Court Thane. Looking at the urgency of the matter can you please advice me what Should I do, and how can I believe this advocate and what will your best advise be.

Sir, I beg of you to please reply to my mail as I have no idea what to do and my such a big amount has been blocked for the past 3 1/2 years.

i am having a commodity trading account with kctl.on march 9 i had given them 2 cheques for rs 45000 n they gave credit for that amount.but on march 14 they had reversed my cheque entries of both cheques n squarred off all my positions. i had sufficient balance in my bank account to get those cheques cleared.the positions they squarred off would have fetch me a profit of rs 159800 very next day.
i had mailed them very next day of the incidence about my loss due to their deficiency of service and it was their duty to get the funds transferred from my bank account to their bank account. but they never bothered to resolve that matter. can i file a case against them for deficiency of service

I had purchased this Vehicle Premier Rio on 26/08/2010 and after few days of purchase the vehicle started to give all sorts of technical problems.We approached the authorised service centre and all the time they kept the vehicle behind at their workshop but when given back to us the problem still remained.As for date the vehicle has a big list of technical problems to be rectified.Recently the Dealer/Authorised service centre owner has spoken very rudely to us and said he is not interested in rectifying the problems.We contacted the company(Premier Limited,Pune),they say to send the vehicle to pune for the repairs but the transportation(diesel and driver) on the vehicle owners cost and responsibility(which is not acceptable by us),the Dealer is not taking any responsibility.The vehicle is under three years warranty.At present the vehicle is at the service center.

Sir kindly guide me the legal way to deal with this above said issue.Since i am not satisfied with the vehicle can i claim for full refund of the vehicle?what will be the legal procedure?

I am disappointed with the content I received. The frustrating thing ever is I am not audible to the receiver when I receive the call. At this point of time that too from the day I received your product I am pretty frustrated with the mobile feature and the features that are mentioned on the mobile cover box. We put our child in a school considering its proximity to our residence. At the time of admission school was in a temporary building and showed us a land close to this structure where they promised to build the school and shift by 3-4 years. Now that land has been sold to a builder and the school is planning to take-up something far and this temporary building needs to be vacated by next year. The school made money from the land and by charging us high admission fee. Now we have no clue where the school will be next year. We are trying to file a consumer case for the same. Please help.

Message: we had purchased a Model Electra – 3000 LPD Solar Water heater system for our Hotel (Hotel SilverCloud, Opp. Gandhi Ashram, Ashram Road, Wadaj, Ahmedabad) from M/s Electrotherm, Ahmedabad. Quotation from Dealer of Electrotherm Ms Yobykes dated 16/11/2009 vide no.:
MYE/Quote/09-10/003 and order copy dated 26/12/2009 from Hotel silvercloud in attached herewith.
The above referred 3000 ltrs capacity solar water system was installed by Electrotherm in the Month of August 2010. While of the installation. Hence it was replaced by M/s Electrotherm in the month of September 2010. We started the Hotel from 08/10/2010. After starting again it was found that replaced tank is leaking and hence it was brought to notice of M/s Electrotherm. At that time from October 2010 to January 2011 M/s Electrotherm welded the tank no. of times and their technical team and Service person Mr. Mahendra Mittal visited the site very frequently. Then they again decided to replace the tank and replaced the same approx in the month of January 2011.
Then again in the month of April 2011 it was noticed that even replaced tank is leaking and hence again the technical team and RM of West region Mr. Sameer Nakara and VP Mr. Rangaswami of M/s Elecrotherm visited the site several times and they decided to split 3000 ltr tank in to Two 1500 ltr capacity tanks and accordingly they did in the month of June 2011.
Subsequently again in the month of September 2011 one of the 1500 ltr tank started leaking. Again M/s Electrotherm was informed. Again the technical persons, R&D person Mr. Ravi Karoria, GM Mr,Jaydev Desai visited and now M/s Electrotherm is stating that because of the water quality this problem is there and warranty period is over and hence they shall replace the tank on chargeable basis.
At the time of negotiation and in the quotation of Electrotherm at the time of ordering there is absolutely no such condition of water quality. In fact it is explicitly mentioned that Application is bathing. At our hotel we have water from Ahmedabad Municipal Corporation. We get water from AMC which is much more than our requirement. We have 9000 ltr capacity water softening plant of “Ion Exchange co.”Water from u/g tank first goes to a primary filter and then it goes to Softening plant and then after it goes to Solar water heater. In fact this filter and water softener is also not asked by M/s Electrotherm, but we installed by our own for better quality of water. At the time of purchase process and in terms and conditions nothing has been mentioned about the water quality by M/s Eletrotherm. All other solar heater manufacturer also do not insist for such criteria. If at the time of order they would have mentioned such condition that definitely we would have preferred other supplier. This solar heating system is for bathing purpose not for drinking water !!
In fact in spite of severe manufacturing defects in water tank we have always took positive attitude and extended our cooperation and even bear certain cost at our end at the time of replacements of the water tank. Instead of finding out the technical reason for leakage of the tank they are diverting the issue towards escape from their responsibility. Different versions like earthing problem, Electrolysis effect, High TDS etc were told by officials of Electrotherm. During this period even there were frequent problem of burning of electrical heaters. Initially they installed four heaters of three KW each. Then after repeated problem of burning of the heaters they declared that it is due to timing difference of cut off of thermostat and then they replaced four heaters by two heaters of 4 kw each. In short every time they made experiments to cure the problem. Without giving the proper solutions they just made the continues R&D at my premises every time.
In fact from the day one of installation this problem arose and they did several trial and error and then replaced the tank thrice within nine months of the installation. At present Due to their absolutely non-professional, unethical behavior and inability to find out the technical solutions since last more than 45 days we are facing the severe problems due to leakage of the tank. Now winter is coming and company is unable to deliver the technical solutions and stating that they shall charge for the replacement. In fact under MNRE (Ministry of new and renewable energy) all solar tanks are having the
warranty up to five years and that too it shall not have any manufacturing or design problem at supplier end. Apart from that even in our order we have explicitly mentioned 15 months warranty from the successful installation. Here since from the inception this problem is there due to wrong selection of the tank material by supplier and hence it is the design and manufacturing problem and it need to be rectified at our satisfaction by the supplier without any cost. At present M/s Electrotherm is denying to rectify the same. We are enclosing herewith copies of relevant communication. We request you to intervene in the matter so that supplier shall not escape from their basic obligations. We request you to extend your help to build the pressure on M/s Electrotherm to resolve the problem from root level

Now they have sent me a bill of Rs 4,000. When i called to the Customer Care and asked for the details of this bill, they said that they have charged 4,000 Rs for net usage.
But this is simply cheating
They are simply cheating their customers. This is a simple trick to cheat the customers…..please help me on this and connection is on my father id who is army officer and now executive told me that if you dnt pay the bill then there would be a problem to my fathers pension.
Please guide me that what steps can I take on this.

i am a surgeon and operformed appendicectomy on a patient. the appendix was found ruptured and after surgery next day he was referred to DMCH DARBHANGA,a medical college . He is alive and all right . still his mother filed a petition alleging negligence. the dist. consumer forum amarded Rs 2lac fifty thousand against me. I filed appeal against this order in state consumer redressal commission. now the dist. forum is insisting i must pay the amount to comolainant and the state consumer redressal commission says i must deposit the whole amount in the district forum . what are my options?
may I file a n appeal in tht High COURT?

In January 2008, I had taken a funding by pledginig mine mine and family members’ securities with ICICI Bank under a ‘Loan Against securities’ facility offered by the Bank.
The funding was provided upto certain % of market value of investments as on that date. If the funding already provided anytime crosses the specified % of market value of investments, then the funding made above that % was to be paid back by the borrower to the Bank.
The market crashed post January 2011 and BSE sensex level tanked from 23000 to 8500 by November 2011. Since the funding of about 7 Lakhs provided by ICICI Bank crossed the specified % of the maket value of investments, I was sent a reminder letter and also received calls to pay back the amount of funding exceeding the specified % of the market value of investments. While I could not pay the entire amount called for but I managed to atleast deposit certain amount that also couple of times. However, since I could not deposit the full amount called for, the Bank started selling securities in tranches in November and December 2008 without even informing me that they will sell securities today. This was beyond my imagination as I was having a good credit profile and I could have easily repaid back the entire money within 4-5 months time out of my own salary. Also my porfolio contained all bluechip securities which could have anytime taken the market value up. Also,the amount to be paid back was hardly 1 or 2 lakh which I could have even arranged from relatives had I known that they will take such harsh measure of selling blue chip securities at peanuts value.
Due to this action by Bank, I have suffered a loss of about 6 Lakhs when compared with origial cost of purchase. From the date of sale, three years are likely to complete in this November end. I would like to file a compliant in consumer court but I understand it is now time barred as time limit id only 2 years. Would like to know what is the remedy in filing complaint?

My name is Rajdeep, and I’m a resident of Pune, Maharashtra for two years.I would like to have an advice as to what steps i can take against the service station. Let me elaborate the situation.
It was Oct 17th whn i have given my bike to an authorised bajaj service station for servicing.They asked me to leave the bike for a day and will call me when the bike will be ready next day. On Oct 18th they call me to collect my bike,when i go to the service station they said they need one more day to complete the work. I said i don’t have time to coe again and agin and did sked them if they can’t do it i will better go for another service sttion. But they said my bike will be ready next day. I agreed, but my mistake i din’t checked my bike if its there in the premises or not. On Oct 19th they call me at 10:25 AM
and said the bike is ready to be delivered. I went to the service station at 2:00 PM afternoon paid the bill amount and hand overed the gate pass to the security. When i go to collect my bike from the parking of the service sation i was not able to find it. They sent there worker to fid the bike but were not able to find. They said may be one of there mechanic has taken for a test ride or something. I wait ther till 5:30 PM, i was not able to go to work that they. The asst. manager of the service station said he will deiver me the bike at home. But when i asked him does he know who has taken the bike? To
my surprise he does not have an answer. They asked me time till next day 11:00 AM morning. Next morning they said the bike is stolen from the premises. I have gone to the police station as well. They have not filed a FIR yet. They said the service station is responsible if any one misuse the bike. But my question to the service station is what now? They said they will compensate me as per their premises insurence. But as my bike is two years old they wont pay me the whole amount of 72,535. What steps i can take against them need help.
1)I have the documented proof that they have not returned my bike.
2)Have PUC and Registration as well.
3) BUt my bike insurence has expired on 25th SEP 2011.
4)Model Bajaj Avenger 200CC
5) Current cost of the bike is 82,050 and it 220 CC

My several attempts to get issue fixed went in vain.Later 1 representative told me , i will get 50% off on my monthly bill 2nd representative told me i wont be billed since i am not able to use
the service.Later i wished to discontinue this service so applied for disconnection and asked me to refund the money i paid for the device.
Then one representative told him , one peron will call to talk about refund which never happened .
I have not paid the bill till now for obvious reasons . I wanted the tatatele to contact me regarding this but no one contacted me . I have mailed called no help. i have sufficient evidences (recorded conversations ) to prove what they promised .
Today, i got a notice from a lawyer after several months , saI dont wish to pay because it is wrong an their part to ask for money for their bad service .Please advice.

3 months back got them a LED TV.I had got it from a shop from where we are buying since all most 10 years. I had billed for a TV with bill but shop owner convinced me to get a TV of bigger size but without bill and warranty .He assured that electronics good will not have problem for a year ,so no big deal .Since we know the owner very well we trusted him and ordered for the TV. The owner got the TV and placed in our home .From the first day it did
not work and we had to call him again .He told it was a cable problem and after 10 days he replaced the cable and made it work. Within next 2 months the TV started giving problems and is not displaying color. We had brought the TV for RS 29000 .Now the TV mechanic says that a main panel in the TV is faulty and it needs to be replaced. The panel cost is Rs 16000.When we said this to the Shop owner he say he can’t do anything about it . He said you can go to
any court and complain. I have a bill that says ,I had purchased a TV from the shop. I just wanted to know if I can file a complaint in the consumer court
for this. Please Advice as soon as possible.

We took loan against property from HDFC bank in Nov 2008 and in Oct 2011, due to very high rate of interest; we finalize to close the loan with prepayment and finally paid all payment as per bank instruction on 31st Oct 2011, now awaiting for original document to receive from bank.
On 12th Nov 2011 we got call from HDFC bank Pune- Area Sales Manager from his mobile. He said that there were fire in HDFC Mumbai –
Kalamboli office in Sept 2011 and your property document is burnt in that.
I am expecting help/guidance from your team:

1. If they are lying/ cooking something – How to manage that and make sure all our original property documents I will get back in correct manner?
2. If they are saying is true – Then what we can do to get original documents from HDFC bank properly and for losing original documents is there any implications (specially while re-saleing property?). Also can we claim with bank for losing original documents?
3. With this loan process we torched from beginning to end (from rate of interest negotiation to document hand over ), any compensation can we ask for that?

I would like to bring to your attention the following case in connection with my claim for full refund of confirmed E-tickets cancelled on the date of journey, i.e. on 05th May 2009 because the train 8478DN/KALINGA UTKAL EXPRESS was running abnormally late by 10 hours at Tatanagar Jn. – the boarding station. Since we were a marriage party we had to make alternative travel arrangements to reach destination in time. A copy of Late Certificate No.
SM(GAZ)/TATA/Refund/11 dated 01/07/2011 issued by Station Manager (Gazetted), Tatanagar, S.E. Railway is enclosed, which is self explanatory. According to prescribed railway rules, I am eligible for refund of full fare without any deductions. From the statement below you will observe that I have been refunded less than 50% of the fare by IRCTC, which is inconsistent with Railway rules.
After pursuing the matter regularly with IRCTC for 31 months I am now told by TDR Team/Refunds, IRCTC that CCM/ECoRly.(Foreign Railway Zone)
has repudiated my claim on grounds that the above train was not late by more than 3 hours and I have not submitted the letter of authority on behalf of the passenger. I am the Claimant since I purchased all 11 tickets for my guests. Ironically I have been given full refund on PNR NO.2156844915 and 2256837784. I am at a loss to understand why or how they are repudiating my claim of the other cases?
I therefore pray that you will kindly study the matter and advise me the best way to get full refund of the balance Rs.11,600.00 from IRCTC, as entitled. And can I claim damages for harassment?

But after 1 and half months I noticed that the paint from left hand pillars are peeling off after getting air bubbles in it and there are so many manufacturing defaults like (faulty gear console cover, rattling problem in steering, noise in driving seat,back bumper noise). I had personal talk Mr. Saurav ( Paint shop expert) based in Hyundai plaza,
Mohan co-operative branch, New Delhi on 25 october 2011 . They told me that I got the delivery of my car after some paint job in my new car.
I got surprised after listening this. Then I talked regarding this with Mr. Ankur Sharma( Customer Care Manager in Hyundai Plaza,Mohan co-operative branch, New Delhi ) on 30 October 2011. He told me to bring my car on 31 October 2011. I brought my car to Hyundai Plaza on the same date. They took my car and kept it for 7 days.I kept calling them for 7 days they told me that this is under process. On 5 November 2011 they told me that you can take back your car. Your car can not be re-paint because it have external damage this is not done from our side. After this again I got call from Hyundai Plaza,Mohan Co-operative Branch,New Delhi to bring my car again and they told me that they will paint only the piller on good will. So now I want the complete check of paint(paint the complete doors not the panels.) and car and solve the issue at a single visit and in written that the paint will not go off with 2 years of warranty.I had given my car to Hyundai Plaza more than 10 Times. But they were unable to solve all the issue.
I hope I will get good support from your end. Coz this is quite frustrating when you purchase a brand new car by spending 6 lakhs rupees on it and you hear wording like this. Mr. sumit(9873180713) was handling this case.

I had purchased a Spice Mi720 Android tablet from a Spice Hotspot outlet in Bangalore vide Invoice no:1985 store code: M47 on 26-09-2011. for Rs. 12,320/-
As soon as I purchased I noticed that there was a problem with the accelerometer and I made multiple visits to their service center. They had no clue how to rectify the same. I then wrote to the customer care center of Spice and couple of more mails exchanges later the service center gave me certificate that the device can not be repaired and I am eligible for a replacement.
However I was also told that the problem is a manufacturing defect which exists in all the Mi720 tabs. So taking a replacement for the same device would be useless.
They then told me that I can buy something else for the said amount. I do not wish to buy anything for the value and I asked for a refund. I was told that they do not have a policy of refunding the amount and showed the conditions on the invoice as support.
I need to know how can they refuse refund when they are actually cheating the public by selling defective product.
I understand if they refuse a refund when I ask for it when the device is working fine and there is no problem with it.
Please guide me as to what actions can I take?
I live in Bangalore and the invoice says all disputes will be subject to Delhi Jurisdiction?

The case involves rejection of Own Damage claim of a Passenger Carrying Commercial Vehicle by the insurance company on the ground of voilation of Route Permit. It may be submitted that the vehicle was actually taken out of the state to meet some medical emergency & to evacuate a patient to hospital.
The IV met with an accident on its way back & at the time of accident there were 6 people (passengers) onboard the vehicle (within the registered carrying capacity) out of which 2 died. The vehicle is a case of total loss, however, the insurance company has repudiated the claim on account of voilation of route permit. Is there any legal remedy available? Please guide with the case laws, if any

I purchased a flat at Shaheen Bagh in jamia nagar PS in October 2009. The area is not authorised so I received POA and other related papers.
I immediately applied for a meter. In Nov 2009, I first received a rejection letter and then later in December the meter was installed very near to the main entrance though I asked the BSES people to install it inside but they didnt pay heed. I shifted in my flat on 21st jan 2010. The first bill was received in March that was not based on actual reading (Rs 60). The complete billing started in May and then on, the billing has remained constant and I do not have any
arrear. Infact in July they had sent a letter stating that my consumption has increased and hence the load upgraded to 4 kw for which I need to submit an additional security amount of 1800 that I paid in the Sept bill of 4290. In brief, till date I have complete record of bill paid and no arrears (See attachment).
On 22nd Oct 2011, I received an NBW informing me about the case filed by BSES against me and one Arif. It mentions that I am the registered consumer and Arif is the user of the stolen electricity. They have given an inspection report dated 24/02/2010 stating that three people visited my building, found my flat locked (as in fact I was in Patna in those days). They wrote that I am stealing electricity directly from the BSES pole. The electricity is being used to light 100 bulbs, 150 pedestals, polish machine, motor and the theft assessment done at Rs 100307. Now what is surprising is that in the pictures provided by
them they show the items to be kept in the ground floor and parking. I have no connection at all with them. I own a flat on the third floor (one out of thirteen flats in the building) and was the first to get the meter installed. I shifted when the finishing works were still on in some parts.
Another incidence that occured last year sometime in August 2010 (I do not remember exactly but quite sure). On returning from office, I found my meter extracted and missing. I rushed to the police station to file an FIR but they refused saying that the BSES officials must have taken it. After much troubles, I could locate a person of the raid team who had taken my meter. When I met him he apologised and said that the meter was wrongly taken assuming that it was the builder’s meter. That person himself got my meter installed. Though I felt that the meter is damaged, I was not sure and waited for the bill. The billing was proper and the billing record says that there has not been any change in the billing.
Please suggest a proper course of action as it is really cruel on the part of BSES for imposing such a penalty for an honest consumer whereas thousands of residents and builders are stealing electricity day and night. Please let me know how can I get justice.

Sir, a package was send through DTDC courier from Kolkata of docket no. F061465966 on 18-10-2011 for Gorakhpur,UP. After non availability of the product when inquired from Kolkata office it was reported that the package was delivered. On inquiring the matter at GKP office it was again shown that the package was delivered. On asking for the recipient’s signature it was found that some hand written other person’s name was on the receipt. On asking for the delivery man named IQBAL AHMED it was told by the GKP office that the delivery man is missing and not known.It is very stunning that how such a renowned courier service can deliver such an important package costing around Rs.50,000/-(Fifty thousand) in this way without handing over the package to the proper person. I am very sure that my costly package has been stolen by the delivery man and the matter is been supressed by the Gorakhpur office whose manager is Mr. Hari Om Shukla ( Mob. No. 919369084414).

dear sir, I am a client of tata securties and due to there website technical fault. they loss me about 30040 rupee.
I had placed a buy order of NIFTY option 4800 put-1000 quantity in 61 rupee.but when that order does not pass, then i change the price 61 to 70 and then full order quantity passed and i sale 1000 quantity at 80 rupee. That time order book was showing 1000 quantity buy and 1000 quantity sale.
But the problem arises when,at market close i recieve the order details by email, which was showing the 1800 qty buy and 1000 sale !!!!
because the website was not showing 1800 qty excuted, i sale 1000 qty and later i come to know that 800 qty is remain pending First when i complaint the company about this matter and they took so much time to check the system. And in between after nearly 48 hours the market price of this has been break down alot to nearly half and unwillingly i have to sell 800 qty in 25 rupee at the loss of 28800+brokerage while trading, order book was showing me 1000 qty (which i later come to know was 1800qty)
Here, i want to know that, how is this possible that Order Book shows 1000 qty buy and 1000 qty sale,on the other hand Trade Book shows 1800 qty buy the company send the order book showing the remainig orders that was excuted at there privious time, which is not possible !!
The company has no answer to it and after a month, they said that “you shoud see the order excuted match only” i had even asked this matter to top mangegetment of Tata seurties like-SWARNA SONI -delhi head ,SANDEEP SAIN bombay head my relationship manager and company,s IT expert-RAJESH.PILLAI , but didn’t get any satisfying answer from them

On the night of October 17, I was asked to leave the premises of E-Gym while I was still a member. I had been asking them for a receipt or ‘proof of membership’ since March for the payment made for yearly membership. Since September, I had been asking them for a refund since I was unhappy with the services provided. Instead, there was almost a physical fight, during which, I was shown the Admission Form which stated that ‘under no circumstances would
the payment be refunded’ and that I ‘exercise at my own risk’. I maintain that these do not hold true under situation of injury and incompetence.
a. Despite a lower back ache, I was asked by an instructor to use the treadmill. While running, I felt a sharp pain in my back, slipped and
fell on the running treadmill. I was out for at least three weeks and mostly bed-ridden.
b. During an exercise involving free weights, the trainer left the scene and I was left to manage the weights by myself. I had to drop them since my shoulders were aching. In their defence, the trainers claimed that they are over-worked and worn out.
c. The weight of the ‘Olympic bar’ was undervalued and I was assisted in lifting more weight than I could handle. Despite my complaints of pain, I was told that such pains are normal. I finally injured my right shoulder and could not open doors without feeling some discomfort.
I am now told that I have no proof for injuries – which is true. I attended to my leg injury in a private hospital and only gave ample rest to my shoulders.
On the leg injury day, CCTV cameras were dysfunctional. I am also told by the owner that they are rich, have several properties and can simply hire a lawyer to deal with the case and counter-sue me. The police cannot touch them and things would happen to them only if this were a foreign country.
On a ‘friendly’ basis, they are prepared to give me the refund if I give them a signed document, on a letter-head stating that I have been given the refund and shall have no other business with E-Gym. Not giving me a card/receipt. Asking me to leave the premises. Injuries. Threats and confrontations. I’d like to define this as harassment. I have gained little from the gymnasium when compared to the problems faced.
This, in short, is my complaint. I am prepared to explain in detail anything asked of me.

This is to seek your advice getting solution for non-resposive behaviour and cheating with customer/investor. I buy my TV under MANO YA NA MNANO offer in March 2008, under the scheme they offered 32″ Plasma TV against bond Rs 7000 for 3 year period. They has cheated pepole by not declare the feature of the TV
set at the time of offer. On complition of period, companey declared the feature of the plasma TV which is far degraded verson than current trend and upgrading it cost Rs. 16990. Also compney has started misleading the bond holder by telling that Plasma display is old technology it is not in trend.
Videocon companey has confused and frustrated me by non-getting right information for what to do with bond certificate.
Mean time they has offered me a SAMAY SE PAHLE HAQ SE JAYDA scheme in which they will offerd me 32″ LCD TV model VRL32HGM on BOND plus 6000 rs. I entered in scheme on 09.09.11 and I am waiting for deliver the my dream TV which must be delivered on or befor 09.10.11. When I contacted to videocon BMO, Ahmedabad office on 16.10.11 they are uncertain about delivery of TV. Please advice, how can I deal with such stuborn attitude of the videocon management.

I am highly disappointed with the the LG fridge which I received from Vijay Sales Hadapsar in the month of May 2011. The fridge I received did not do any cooling so..I lodged the compalin and……….
1. after 25 days the technician came and reviewed the fault
2. again after 15 days the technician came and refilled the gas
3. it worked for 10 days and then again resulted in same problem
4. I reported a complain and then after 1.5 months technician came and asked to replace the fridge.
5. It got replace after 20 days
6. The replaced fridge rings ALARAM after every 5 mins and stops cooling.
7. I again register the complain. after 4 days I receive a call from customer service to PUT COCONUT OIL IN THE ALARAM SWITCH TO STOP THIS malfunction. ( WHat NONSENSE )
SO SINCE 5 MONTHS I HAVE PURCHASED THE FRIDGE I AM NOT ABLE TO USE IT.
Please help ….

DIstrict forum has passed an ex-partee judgement against me but due to our office staff mistate we unable to file appeal near about 300 days we came to know the judgement when the collector issued a notice for recovery then i had made appeal and filed delay application to condone delay of 300 what are the chances that i will win the case and the court may condole the delay

I had received a call from a Indian Health Organization (IHO)’s telecaller on 27th/28Th Sep’11 about their schemes on health plan green cards. He said that if I pay rs.6600 for the 2 years, and I’ll receive 4 green cards for my family, along with many free vouchers. With these cards, I’ll be able to avail any doctor’s or any hospital/Nursing service national wise with minimal costs, with high range of discounts even in any medical store also, as IHO has tie-up
with all of them,
He said, after the booking, I’ll get immediate e-card on my phone, through same I’ll be able to use, before the actual cards reach me by courier and I’ll be able to use this e-card for 14 days, and in the mean time, if I feel like cancelling it, I’ll have just call customer care and within 14 days they will chancel same without any issue and will return my whole money without any deduction. Or if I continue with IHO than I have to pay the Credit Card Company/ Bank after 50 days of the booking, as they have tie-ups with the banks accordingly. But I came to know that IHO has already deducted money from my credit card on 28-Sep-2011.
I did not received any e-card from IHO in my mobile in some days so I called customer care she told me different details about e-card, card claim procedures and said that they do not have tie-up with all the doctors and medical store and whatever telecaller said most of the things are false only. I asked her to cancel my card, she has given me one complain number that I’ll get the call from cancellation department to cancel the card and they will take 14 days to complete the steps.
I called so many times IHO and wrote mail also. I have given them my office’s number for contact me as well as stop my DND services (Health). But did not get any reply from them.
Today also I contacted them but again did not get any positive reply.
Customer care said that I have to wait for their cancellation department’s call.
Neither I am getting the call from IHO cancellation department not they are giving me any feedback or reply on my query.
Please guide me that how I can get my money back.

I have bought New Mobile Handset from local store of Ranchi on 20/8/2011.
I have observed the problem of very loose connectivity in this set right from second day and complained the shop. They have kept the handset and repaired this and returned to me after three days but i found to memory card of 2gb was missing from the set and they have rejected my request to return my memory card.On very same evening after using the handset I found that Video camera and camera is not working and i have informed the same to the shopkeeper over phone. They have again taken my mobile set and repaired the same and returned me back after four days. Just after this the same set started to hand
frquently and couple of keys became dysfunctional. I have requested the shop keeper to reurn the product or money. They have refused than I have refrred the Right & Entitlement of Consumer under Consumer protection act 1986. They have ignored this request and virtully insulted me. Now I would like to go to the District Consumer Court rquesting them to order the SHopkeeper or related company to return my Money. I have original cash memo and all the other documents of the handset with me.
Kindly guide me and help me accordingly.

It has been clearly specified by TRAI act that a sim card can send max upto 100 sms/day. Before such notice we could send bulk sms on special ocassion, so during that time service providers used to charge for 1 sms 1rupee approx. But as now there is a limit of such 100 sms only then why these service providers are continuing charging so high rates on special occasion. they are NOW violating the rights of we consumers. Kindly suggest me if i can file this complaint in consumer forum.

At the time of counselling and admission we were told that after completing Post Graduate Diploma in Finance we will be able to convert it to Masters in Finance degree that even from University of London. Where as within first 10 days of session we got to know that injstitute does not have tie up for masters degree with University of London & they cant provide masters degree to us. We asre total of 9 students who are raising our voice against the fraud and have paid minimum of 1.3 lakhs to the college, which they are denying to return and are saying “Jo ukhadna hai ukahd lo”.
Police has failed to register FIR for the fraud as it seems they have received money.
Kindly suggest what can be done in order to recover the fee paid as we paid it in order to get Masters degree.

I need assistance in Number Portability. I have been using Vodafone network for the last 6 years in Bangalore.I have shifted to new rented house. I am not getting network in this new house. I tried for number portability. As per number portability procedure, I need to send a SMS from my mobile to 1900. I have done it. As per process, I am supposed to get the port number immediately. Wherein I got the call from Vodafone customer care asking for reason why I want to switch to different network. So I am pretty much sure,my message has went to the correct team and Vodafone company dont want to allow me to switch to
differnet provider now.I have done followup calls to Vodafone on this. I have been getting extended dates from Vodafone to get this network issue fixed. I need assistance on how to take this further.
