The order dated 23 February 2012 is as follows, whereby Speak Asia has deposited the amount as per the order of the Supreme Court of India.

UPON hearing counsel the Court made the following
O R D E R

In pursuance to the directions of this Court dated 6th February, 2012, respondent Nos. 3 and 4 have deposited an amount of US $ 10 million by way of a bank draft bearing DD No. 037002 dated 20th February, 2012 drawn on State Bank of India, Singapore Branch in favour of “The Registrar, Supreme Court of India” in the Registry of this Court.

Learned counsel for the respondent Nos. 3 and 4 submits that this amount be deposited in a fixed deposit for a period of 91 days initially with the UCO Bank, Supreme Court Compound, on an auto renewal basis.

This request seems to be reasonable and we order accordingly.

We also direct the Secretary General of this Court to invest the amount today itself in the UCO Bank, Supreme Court Compound for a period of 91 days on auto renewal basis.

With these directions, this application stands disposed of. However, it is made clear that the disbursement of the amount would be subject to further orders of this Court.

Learned Additional Solicitor General undertakes to file an Affidavit. She may do so within a period of two weeks.

Reply, if any, thereto be filed within two weeks thereafter.

Harassment Complaint against IDEA Cellular & its Pitam Pura store, Delhi

Complaint against IDEA Cellular Limited, ‘Windsor’, 5th Floor, Off CST Road, Near Vidya Nagari, Kalina, Santacruz(E), Mumbai – 400098 and V.S Technologies, IDEA Store, 279, Rajdhani Enclave, Pitam Pura, Delhi – 110034

Complaint by a senior citizen (name not disclosed due to confidentiality, facts have been verified)…

I opted out of previous Telecom provider, Vodafone and selected IDEA as a service provider due to good post-paid plan options in mid August 2011, whose first pro-rata bill was generated on 10th September 2011.

I subscribed to Combo 249 plan (including 1 GB data) and also to Rs 299 Blackberry plan initially. Though, was surprized to learn that GPRS service would be deactivated on Blackberry services, which was never the case with previous service provider.

But for the best reasons known to the IDEA company. Further, they deliberately put up a credit limit of meager Rs 750 for the said Mobile number, unknown to me.

The first bill was generated on 10th September, 2011 but being charged proportionately, it was below Rs 500. And the credit limit was never verified or noticed, being very new to the Addressee Company’s services. The same bill was paid by cheque at Connect Communication, TU-19, Pitam Pura Idea Store, located near Hotel City Park.

In the first week of October, I was on Punjab Tour and thereby incurred more charges on roaming. And as a result on 10th
October 2010, around noon time, I received a message that please pay some amount, as you have exceeded credit limit and the due amount is over Rs 800/-.

And within an hour of SMS from IDEA, my outgoing call, SMS services and Blackberry services were blocked. Immediately, I registered a complaint with IDEA and questioned/protested their harsh behavior, as 1-2 hours notice is impossible to comply. Further, requested for immediate restoration of services and a copy of the BILL be emailed to me, as it was difficult to understand as to how I have exceeded the credit limit. But the bill was received till late at night on 10th October 2011 only in normal course. And due to the interruption of the services, my work suffered.

It is pertinent to mention that 10th October 2011 was a Monday, which is weekly off, for both the stores located at Pitam Pura. So in any case, it was not possible for me make payment on the said date.

Further, I requested for increase in the credit limit over the telephone, to which customer care replied that it can be done at Idea Store only. And in protest I requested for deactivation of Blackberry services on the 10th October 2011 evening, which was de-activated the same day. And on the next day, I visited the Connect Communication at Pitam Pura first but it was closed on Tuesday also.

I immediately called Idea Customer care and after lot of waiting, got information as to other Idea Store located nearby, i.e. V.S. Technologies, Pitam Pura, Delhi and rushed to the same after searching for the same and complained about the ill-treatment and requested for the resumption of services at the earliest but it was told that services would be resumed only on payment.

I intended to make payment through cheque of proprietor business but I was told, either pay cash or wait till cheque is clear before services can be resumed. On this, after lot of arguments with the customer care and also with the idea store employees (V.S.Technologies). It was agreed that the services would be resumed in the next one hour.

I also requested for activation of 1 GB GPRS services, which I was already subscribed to under the monthly rental plan, as Blackberry services were deactivated. And it was communicated by the store that the GPRS services will take a day for activation. And the same were activated the same night, i.e. 11 October 2011.

On 13 October 2011, suddenly the GPRS services again stopped working and on complaining, it was informed that they were never activated but will be done by next day. Again, the GPRS services worked for a days and again stopped working. Such things kept happening till 19th October, when finally 1 GB GPRS plan as already subscribed was activated on 19th October 2011. As a result, I had to face lot of hardship and harassment.

The harassment continued and the Bill received for the previous month on 10th November 2011, showed GPRS charges of Rs 503.92, though had used just 587 MB of data of 1024 MB available as monthly Free Usage. The same was complained to the addressee No 2′s customer care and after lot of complaints and arguments. Finally, I was informed over the Telephone and also email, that it has been wrongly charged and it would be reversed in the next bill. I have email and audio conversation as evidence.

Still in the next bill dated 10th December 2011, the same amount was not reversed and on complaining, I was asked to pay the Bill, assuring the adjustment in the next bill.

Again in the Bill dated 10th January 2012, the same amount was not reversed and the harassment continued. The said bill is just for Rs 431.22 and the amount to the credit of my client is Rs 503.92, therefore I rightly did not pay the bill and also emailed in the same regard. But a ready made reply came that IDEA representative is unable to get through the number, which was totally false statement.

I registered a complaint to the customer care as regards the credit to be made available to me after due date, as warning messages were aired before I could make any outgoing calls. The customer care representative called back on 30th January 2012 and took a request and assured that no disruption of services will happen.

On 1st February 2012, the outgoing services and data services of my client were again effected. And due to busy schedule of my family on 1st and 2nd February 2012 in school admission process at Delhi. ON 3rd Feb, 2012, I complained about the matter to the IDEA customer care, who instead of accepting the mistake of the company, tried to showed pity over my client and activated outgoing services for just 24 hours, stating that the same would be credited to your account on 06th February 2012 but the services can be activated for 24 hours only.

I visited the IDEA store, V.S. Technologies on 03 February 2012 and explained the situation and also requested that the phone should not deactivated again, as the credit is lying at addressee’s end for more than 3 months. But i was told that the credit would be applied on 06th February 2012 only in total disregard to IDEA Company’s mistake in applying the credit to my account in time.

Still I did not get any respite and outgoing calls were again deactivated on 4th February 2012, which is totally unfair, deliberate harassment and lack of care for the customer because when addressee company is fully aware about the fault at IDEA Company’s end, which was referred to as system error, then why I am being punished ???

Further, it is questionable as to how the credit limit of my client has been increased from Rs 750 to Rs 1,700, without putting up any request in this regard ???

Then, legal notice was issued to the company on 04th February 2012. And as a result finally a phone call was received on 06th February 2012 that the credit of Rs 503 will be applied to my account. But on 08th February 2012, my mobile services were totally suspended, which left me with no option but to pay bill under protest, as it was not less than a blackmail !

On complaining at IDE store – V.S. Technologies, I was told that it takes one week to apply the credit, therefore the further bill received dated 10th Feb 2012 also didn’t have any adjustment for those Rs 503.

Also, the legal notice served twice to V.S Technologies, IDEA Store, 279, Rajdhani Enclave, Pitam Pura, Delhi – 110034 has been deliberately returned, so that the harassment of the customer can continue by the shameless IDEA company and its store !!!

Mumbai: Brothers pay for filing baseless case in consumer court

Filing “baseless” claims in a consumer court can invite dire consequences, as three brothers from Matunga realized it the hard way. The three siblings were fined Rs 30,000 by a consumer forum for dragging a builder to court over complaints that were “devoid of substance”.

Recently, the National Consumer Disputes Redressal Commission too pheld the State Consumer Disputes Redressal Commission’s fine order on the Nawathe brothers-Rashmi, Pradyot and Prakash-all residents of the 11-storey Rajbaug Building on Deodhar Road in Matunga.

Consumer forum fines ICICI bank for wrongful delivery of ATM

ICICI bank has been directed by a consumer forum to pay Rs 20,000 as compensation to one of its consumers whose ATM card was delivered to a wrong hand, who withdrew money from the account fraudulently.

The ATM card landed at a wrong address and was used for withdrawing over Rs 48,000 from the savings account of a person, who was waiting for the same to be delivered at his address.

A District Consumer Disputes Redressal Forum (Central) gave its ruling in the favour of account holder Datta Ram, saying that the act of the private bank caused “mental agony and harassment” to him for its failure to return the money to his account in spite of information that it was not withdrawn by him using the ATM card.

Chandigarh: Waterlogging damages cars, residents win claim

Two Tricity residents, whose cars got stuck on waterlogged roads during the monsoon, have got relief through the UT Consumer Disputes Redressal Forums after their claims were denied by the respective insurance companies.

In the first case, Harjit Singh, the Proprietor of Kanwar Enterprises in Industrial Area, Chandigarh, had to knock the doors of the Consumer Forum after the insurance company denied his claim. Singh told the court that in July 2011, he was going from Chandigarh to Mohali when he was caught in heavy rain. His car stalled at the YPS crossing in Mohali. It had to be towed to the workshop the next day.

The AC and radio of the car were not working. Singh paid a total of Rs 1 lakh approximately on repair, and submitted the insurance claim to the company.

Mumbai: Consumer forum asks airline to pay Peddar Road resident Rs75,000

A city consumer forum has directed Kingfisher Airlines to pay Rs75,000 to a Peddar Road resident for failing to accommodate his family members on another flight after their flight, for which tickets were booked six months in advance, was cancelled.

The Mumbai Suburban District Consumer Disputes Redressal Forum found much substance in the allegation levelled by Sanjay Banga that the airline had cancelled several flights during the period in order to compel passengers to purchase new tickets by paying full ticket amount at the eleventh hour, and thus get rid of tickets booked in advance at concessional rates.

Mumbai: Pay Rs30k for losing customer’s handset, mobile-maker told

Three years after Gurav Sharma, a resident of Marol, Andheri (east), lodged a complaint against Samsung Electronics Private Limited, the District Consumer Forum has directed the company to pay him Rs30,000 as compensation for failing to repair his mobile phone.

A division bench of JL Deshpande and Deepa Bidnuskar observed, “It will not suffice to order the issuing of a new mobile phone, as the complainant must have already purchased one. But the mental agony and harassment caused to him during the intervening period without a phone, and the efforts gone into filing the complaint and following up through a lawyer requires to be compensated.”

Delhi: Discom to pay Rs 10K to woman for inflated bill: Consumer forum

BSES Yamuna Power Ltd has been asked by a consumer forum here to pay Rs 10,000 to one of its customers as compensation for “harassing” her by sending an inflated bill and then disconnecting her electricity supply for not paying it.

The Delhi District Consumer Disputes Redressal Forum said that the “arbitrary and illegal” act of the discom of sending an inflated bill of over Rs 81,000 to the complainant, Zarina Khatoon, amounts to “deficiency” of service and “illegal trade practice.”

I am getting constant threats & abusive language from these numbers. I will be filing a Legal offence against these numbers within the next 24hours & would also request you to kindly block all incoming call from these numbers to my number at earliest.

I was looking out for a 2 bhk apartment on rent on the 15th of january 2012 on sunday.I booked an apartment in kandivali east with krishna realtors in thakur village and gave a token of rs 10,000.Due to some reasons i had to cancel the booking and i informed the agents on tuesday(17th jan) but the agents are not ready to return the money back.I hav the receipt with me for rs 10,000 but there is nothing mentioned in the bill regarding non refunding of money if bookings cancelled.I am very dissapointed by the attitude and behaviour of the agents……plz help me!!!!!!!!!

I request to your service centre manger to that i had purchased this mobile from KANPUR and now i was in DELHI, Kindly please exchange this mobile from DELHI. But they told me that you can exchange this mobile only from KANPUR.

After four and five days i compliant to your service Centre that my mobile battery back up is very less. They told me that your changer is not good. I purchased new charger and charge our mobile but problem is not solved.

I was forced to take a lawyer by The disstt Forum.I took her with ref from a NGO.she dropped my case in 2010.but her vakaltnama is on my file.president protects her,because she does many LOK AdaLat cases…she first messes them up and then settles them for petty amounts via lok adalat. since my case was filed 2.5 years ago for deficient services the Nationalized bank,has given vague answers to the Forum,which the forum is accepting.They have given a Fake and Fraud bank statement and I have exposed their lies about all that they have stated in their written explanation.I have countered adequately their vague story with proof.What am I to expect from The Distt Consumer Forum.The President keeps telling me to get a lawyer..and also to write…”I do not press
charges”,on the file. I am very upset over the matter.I have removed my ex- lawyer who was linked with the bank lawyer.Iher name is not being struck off my
file.My court attendance was not being marked…….i have raised the issue with The Registrar………….No arguments are held………….leniency is meted out to the non applicant lawyer.My money is missing from my bank account in lakhs and bribe had been asked.By now The Forum should have taken action..instead..managers are going away getting promoted,judges are coming and going…………and i am being side tracked…….please help me ……guide

I purchased 3Gdatacard services for airtel mobile number 8754022409 from airtel on 19 november 2011. This mobile number is used only for 3g datacrd purposes.
Bill for the month december 2011 is charged excess from the basic plan details. My plan details is Rs.1250/ monthly with 12.5gb limited data usage with 7.2mbps speed limit. Speed limit they is only 15kbps. when trying to conact customer care they say it will differ may be no network.
but my signal strength is full without any disruption. further when trying to contact customer care they simply say we redirect the call and finally disconnect the line. During purchase itself too many problems from airtel customer service side right from activation until bill details. When i try to contact customer service they just endup the call without transferring to appropriate person. i wrote to the nodal office but no use.
Bill dated from 8 dec 2011 to 4 jan 2012 as Rs. 5514.21/- Nodal office person earlier when contacted mentioned me that data usage is within the limit and bill amount is only Rs.1250/ as per the monthly plan charges. I confirmed many times. The nodal officer also approved after many confirmations but now they
tell me it has exceeded 13.69gb and so charges is Rs.5514.21/= i have stopped the usage and removed sim card from the device when the nodal officer told me the data usage has reached the limit. when i raise a question to nodal officers reg. this they repeatedly claim there is no bill mistakes from their side.
When i requested for bill copy to be emailed to me, they dont care to send a detailed email copy of bill statements. i have paid only the basic plan payment and told them for the rest of the amount i will not pay until i receive a detailed email copy and verified by me.
So the issue is yet unresolved.

I purchased Consumer products along with household stuff from Big Bazaar. After billing I found there was a mistake in the bill, I informed the same to the cashier and the person on the counter informed me that this is not his problem and he won’t do anything for the same.
I requested to call the inchagre person for the product but he refused. He told me to go to consumer counter which was a long way. I requested again and again but he refused, finally I went to the customer care counter. When I told the problem and asked to call the store manger he refused and told me in case if there is any problem in the billing its customer duty to check the same. They rectified the same and reimbursed the amount after 35 mins of time along with customer harassment. This happened many times that there is error in the billing and the cashier won’t respond. As a consumer right I request the respective department to take a very strong action on the same and if possible take necessary action in order to close the respective Big Bazaar.

And I have placed this order on 20-Dec-2011. and i have call coustmer care regarding refund. they said that refund will intiate in your account within 7-8 working days. after 10 working days i will call again call they raise ticket for me. And In The Ticket They Ask Refund Intiate in 4-Jan-2012 and amount will be transfer in my account within 7 working days. but i did’nt receive amount till…. i have
called 7-8 times but no response from coustmer care. know coustmer care told me that they did.nt receive money from mine account but i will give him Bank Transaction Id Also. Know Every time i call they ask me wait for 2 days or 24hours.i have received Rs.200 GC…But did’nt received Rs.827 refund.

hi sir/madam, i am a user of idea network prepaid past 7 years, i am very upset with idea network service, well recently i tried to recharge Rs110 on 21/01/2012 through e-recharge, but i didn’t get any amount, the person who recharged has got replay as successful message for recharging that amount, he also forwarded that mess with that id, as i called the costumer care for clarification, they said tat ” we didn’t receive any update regarding my recharge”, again i called them on 22/01/2012 to find status about my recharge, one executive said, if i recharge Rs110 for more than 3 times, then ill not be eligible to receive any amount, (iam unaware about this kind of scheme) as i asked about refund of my amount, he said they are not responsible, kindly provide me proper advice to sue the company and to get justice for loss and damage i suffered.

hi,i purchased microwave oven 9th may 2011. stop working,made complaint,thay took 2-3 weeks to attend and get spare parts too 2 months thay decided to replace.and replaced but again stopped after few days, again made complint still waiting after purchased hardly 20 days used still now nothing has comeback.what can i do pl advise me Thanks.

not on Akshaya hostel management.
•She used to steal girl’s things and blame innocent gilrs using vulgar words,about their descipline and charecter and family background.
•she used to chat by anonymally calling those guardian’s name belong to male’s.
•I lost my gold bracelet,silver anklets,\Reliance data card,lap top bag and every possessions starting from toothpaste to perfume. when i told her,she told to call the police just to convince me and on the next day when i asked about that,she and helper scolded me in a rubbish manner that i only used to break other’s locks and im acting, and i should vacate the hostel,else she will slap and make me to vacate.(SHE RAISED HAR HANDS TO SLAP SHOWING VULGAR MOUTH ACTIONS) I surprised on this strange experience and i complained ownwr through phone.for that she captured my phone and again came to beat me.
• Finally 2 girls of my room who got insulted badly by the same lady(Warden) joined in hands in blaming me and gave a Fake Complaint to owner that i spoke wrong about the hostel’s behaviour thereby made me to vacate holding the blame that i only stolen every body’d things CHECKING ALL OF MY BAGS WHILE SCOLDING ME ABOUT MY CHARACTER, I WAS HELPLESS AS ALL OF THE 3 AGAINST ME AND OTHERS KEPT SILENT….
•this is the way a respectable warden should bahave?
• Is it the way girls from good family should behave???(Stealing and blaming the loser inturn to escape from loser’s view).
• What is the necessity to bear these kind of bloody wild animal’s words without commiting any mistakes(even though we lost our belongings) even OUR PARENTS WONT SCOLD US A SINGLE WORD.BUT WE HAVE TO BEAR CRUAL,UN CULTURED,VULGAR WORDS.
• Is it our only mistake that we stayed in hostel,missing our parents?
• what can we do to stop these kind of wardens having link with stealing Girls?

Sir on 26-01-2012 i put rate cutter to my mobile for 195 rs. the shop keeper told and show a chart for 195 i can speak at 10 paise from air tel to air tel. but it resulted in 15 paise for a call i called customer care service they said the plan was changed. so once again i called retailer he said i don get any information. i asked to help me he said what you can do will you complaint in police station go ahead. he answered retortly. he is not updated for that i suffered is there any way to file a case. if i file will it worthy. thank you

I paid stamp duty to DLF in July 2009 to register my property and give me sales deed. The builder did not do anything despite numerous e-mail reminders. When the circle rates went up on 16 November, 2011- the builder forced me to pay extra 3.20 lakhs for the registration and sales deed. I wish to take them to the Consumers Court, but will not be able to attend the various court dates, especially if DLF keeps asking for the adjournment. I will attend the final oral presentation if it is fixed. Please advise if my case qualifies for the Consumers Court and what steps? I have already issued them the notice to reply their side within 20 days, and now it is passed 20 days. I called them and DLF said their legal deptt. is forwarded my notice, but are evasive as when they would reply.

will have to pay the difference, as we know the tax has been incresed from 1st of Jan 2012 only, please advice do i need to pay tax difference or not, moreover untill now they are not delivered the motorcycle due to cyclone their wearhouse getting damage around 40 motorcycle in damage condition so we have send back to company to get the new motorcycle from the company, please advice do i need to pay the tax r not they have been used my money from 28dec2011 to till now, i have called them about this they told that i will have to wait until 1st week of feb for delivery please reply asap.

I am a member of a gym at Rajouri garden known by the name of Celebrity Fitness in Todays mall. Soon after joining I was dragged by there very aggressive marketing staff for personnel training. I was told by the trainer that he would show drastic results and we had to spend a good amount of time to study and understand the program right for me. Now this trainer started calling me around 45 days back that he has some personnel problem and can not come to the gym now, I kept on repeatedly telling him that my contracts get over in jan 24th this gentleman promises on phone to extend as he is the one not owing not
me, after few days he puts me on to some other guy claiming that he will come soon. I was not comfortable with the new trainer so decide to wait and don’t for to gym for around a week when I reach there on 27th I am being told that my contract is over and there is nothing they can do they can do to extend it unless I give them a medical form. I asked them since there trainer has given false and fraudulent promises to me why should I trust anyone new or lie by faking ilness hence please refund my money as i have only take 2 class out of 12 where the trainer also promised he ay give me 15 on a personel note. i
feel cheated and dicieved they have a very frustrating cop rate structure where no one claims responsibly of their mistake please advice what to do.

I ordered this item and paid extra for the delivery and waited a week to get it deliver to the UK adress as they delivery all the countries. when i got the item, i was shocked to see that it was wrong item sent! Instead of saree, i got send two year old salwar kameez! I paid about £70.00 for the whole order and was waiting for this item before the wedding. however i got so dissapointed that i nothing to wear on wedding and i had to go to central london bought this wedding outfit which cost me £100 bucks!!! anyway to complain i send an email and they replied saying that i need to send the proof of images. I send them the pictures and i got email sayiing that they havnt received my images (complete lie) so i forward that same email to another company email address and they did replied to my wrong email adress (meaning that i did not get their reply as they sent to wrong email address!) so i was really angry and called their customer servies and they confirmed the email address and i was shocked that they did not reply to same email address which the earlier correspondece were sent but sent to completely new email. how ridiculous can it get. please help me in how can i sue this company??

I have done work in construction of TELECOM TOWER in Civil Work as a Sub Vendor under ESSENN COMMUNICATION, SILIGURI and the order of the work was from INDUS TOWER LTD. It has been 2 years since the work is completed but I have not got the full payment yet. After paying Rs. 1 lac to me they have not paid the the remaining due amount to me but INDUS TOWER LTD claimed that they had made the full payment to ESSENN COMMUNICATION.From the last 2 years I have repeatedly asked for the due payment but they had not given me any amount instead of that they are making useless excuses. After refusing to paid the due amount to
me, I have filled a complaint in CONSUMER FORUM regarding the matter. Their lawyer petition that this case is not a case of CONSUMER FORUM and the case is under processed. Its my humble request to you to please inform me whether the case is of CONSUMER FORUM or not and kindly help me in solving the case.
